Проблеми та перспективи впровадження системи FLEGT та регламенту ЄС щодо лісової продукції в українське законодавство та практику

Анотація

Метою дослідження було вивчення можливих шляхів вдосконалення національного законодавства в контексті поширення системи FLEGT щодо лісової продукції. Методологія дослідження включала порівняльний аналіз міжнародного та національного законодавства, аналіз статистичних даних щодо лісової продукції. Результати дослідження показали, що впровадження системи FLEGT потребує значної модернізації законодавства та адміністративних механізмів. Порівняння нормативної бази ЄС з національними практиками виявило розбіжності у стандартах контролю та перевірки лісової продукції. Впровадження системи FLEGT потребує вдосконалення механізмів контролю та прозорості, передбачених законодавством України щодо лісової продукції – Лісовим кодексом, який визначає порядок використання, охорони та відтворення лісів. Особливу увагу у статті приділено питанням екологічної стійкості та контролю за нелегальними вирубками. Порівняння України з іншими країнами дозволило виявити ряд спільних проблем, пов’язаних з браком належного контролю та корупцією. Для обох регіонів важливо посилити контроль за дотриманням екологічних норм і впровадити ефективнішу систему сертифікації лісової продукції, чому перешкоджають брак фінансування для адаптації до нових стандартів та необхідність навчання кадрів, відповідальних за контроль над дотриманням вимог FLEGT. Проведене дослідження підтвердило необхідність підвищення прозорості ринку деревини та низький рівень готовності національного законодавства до впровадження нових вимог. Крім того, дослідження показало, що успішне впровадження системи FLEGT може позитивно вплинути на екологічну стійкість лісового господарства та поліпшити міжнародну репутацію держави як надійного постачальника лісової продукції. Отримані результати дослідження можуть бути використані для вдосконалення нормативної бази в галузі лісового господарства
