Цифрові права людини та їх вплив на інтелектуальну власність

Анотація

Комплексні дослідження впливу цифрових прав людини на інтелектуальну власність є актуальними, оскільки це має важливе значення для цілей створення теоретичної бази та подальшого розвитку позитивного впливу цифрових прав людини на розвиток інтелектуальної власності. Метою цієї статті було проведення аналізу пріоритетних напрямків впливу цифрових прав людини на інтелектуальну власність. При проведенні дослідження було використано функціональний, історико-правовий, синергетичний, формально логічні методи. У статті було розглянуто основні сфери впливу цифрових прав людини на інтелектуальну власність. Було досліджено конкретні кроки, що здійснюються на державному рівні з метою розширення та удосконалення такого впливу. Проаналізовано можливий вплив цифрових прав людини на розвиток законодавства у сфері інтелектуальної власності; перспективи запровадження нових та удосконалення існуючих способів захисту прав інтелектуальної власності у цифровому просторі; визначено напрямки впливу цифрових прав на судову практику; досліджено поточну діяльність державних органів України у напрямку захисту прав інтелектуальної власності, у тому числі в кіберпросторі. У результаті, сформульовано пропозиції щодо удосконалення законодавчої бази в частині заходів охорони окремих об’єктів інтелектуальної власності та механізмів захисту прав інтелектуальної власності в кіберпросторі; запропоновано конкретні заходи, що можуть використовуватися при виробленні підходів до доказування у судовій практиці; розроблено пропозиції щодо удосконалення співпраці між суб’єктами державного та приватного секторів у сфері інтелектуальної власності в кіберпросторі
