Конституційні права і свободи людини і громадянина в Україні та країнах ЄС

Анотація

Метою дослідження було обґрунтування концептуальних засад та розробка практичних рекомендацій щодо вдосконалення механізмів захисту прав і свобод людини і громадянина в Україні на основі комплексної порівняльної інтерпретації конституційно-правових положень України та держав-членів ЄС. У дослідженні використано методи порівняльно-правового та історико-правового аналізу, а також системний підхід. За допомогою цих методів було досліджено природу та зміст прав і свобод громадян України в сучасному конституційному контексті. Предметом дослідження стали основні конституційні права і свободи, закріплені в Конституції України та конституціях держав-членів Європейського Союзу. Порівнювався обсяг цих прав, механізми їх реалізації та захисту. Особливу увагу було приділено спільним рисам та відмінностям у підходах до забезпечення свобод людини. У дослідженні проаналізовано відповідність українського законодавства у сфері прав людини європейським стандартам та окреслено перспективи гармонізації правового регулювання в контексті євроінтеграційних прагнень України. Особливу увагу було приділено аналізу правових норм та механізмів захисту, які гарантують реалізацію основоположних прав, включаючи соціальні, політичні, економічні та культурні права. Порівняння України та Європейського Союзу дозволило виявити спільні та відмінні риси у підходах до захисту прав людини, а також висвітлити проблеми та перспективи гармонізації національного законодавства з європейськими стандартами. Висновки цього дослідження виявили необхідність подальшого вдосконалення механізмів захисту прав людини в Україні. Дослідження може слугувати науковим підґрунтям для вдосконалення законодавства та подальшої імплементації міжнародних документів у сфері прав людини в національне законодавство
