Правові проблеми соціального захисту студентства в умовах воєнного стану

Анотація

Метою даного дослідження було встановлення нормативно-правової бази, яка регулює питання соціального захисту студентів, зокрема, під час воєнного стану, а також визначення основних правових проблем з даного питання в Україні та Мʼянмі. Для досягнення мети було використано герменевтичний, порівняльний та історичний методи. У дослідженні проаналізовано концептуальні підходи до визначення соціального захисту студентів в умовах воєнного стану. Зокрема продемонстровано вплив воєнного стану на забезпечення державою соціального захисту та допомоги студентам, а також виокремлено основні правові проблеми даного забезпечення. Було здійснено аналіз міжнародних та українських нормативно-правових актів, що стосуються захисту соціальних прав населення, включаючи студентів. На прикладі досвіду воєнного стану в Україні та Мʼянмі, було виокремлено основні проблемні місця правового характеру стосовно забезпечення соціального права студентів на здобуття вищої освіти. Також продемонстровано нерозривний звʼязок між даними поняттями у сфері надання вищої освіти під час воєнного конфлікту в Україні та Мʼянмі. Було наголошено на необхідності дотримання основоположних прав людини державними органами у здійсненні забезпечення права на освіту (зокрема, це стосується права на життя та здоровʼя, які знаходяться під загрозою, враховуючи систематичні обстріли закладів освіти). Практичне значення даного дослідження полягає у можливості його використання науковцями, для більш глибокого вивчення проблем соціального захисту студентів у державах, де діє воєнний стан
