Правова природа паралельного імпорту в Україні: проблема сертифікації та екологічних стандартів

Анотація

В дослідженні було звернено увагу на правові аспекти визнання європейських сертифікатів відповідності в Україні та їх вплив на ринок імпортної продукції, з метою оцінки можливості спрощення процедур імпорту та посилення українських ринкових позицій. Методологія включала аналіз чинних нормативно-правових актів України та ЄС щодо сертифікації продукції, порівняльно-правовий аналіз систем оцінки відповідності, що допомогло здійснити аналіз можливих фінансових наслідків та правових наслідків маркування в Україні. Було виявлено ризики, повʼязані з різницею в стандартах контролю якості та механізмах ринкового нагляду та констатовано потребу в поетапній узгодженості українського законодавства з нормами ЄС у сфері технічного регулювання, з урахуванням специфіки національного ринку та вимог безпеки споживачів. Запропоновано конкретні кроки для запровадження системи визнання європейських сертифікатів, включаючи створення системи швидкого реагування на виявлені невідповідності та посилення співпраці з європейськими органами з оцінки відповідності. Аналіз також охоплював наслідки визнання європейських сертифікатів на екологічні стандарти в Україні. Було показано, що прийняття європейських норм може сприяти підвищенню екологічних вимог до імпортованої продукції, потенційно покращуючи стан довкілля в державі. Результати вказують на необхідність створення ефективної системи моніторингу та контролю за дотриманням екологічних стандартів при імпорті товарів. Висновки дослідження підкреслюють важливість балансу між спрощенням процедур імпорту, забезпеченням високих стандартів якості та безпеки продукції, та сприянням сталому розвитку української економіки
