Basic principles of the agrarian and legal insƟtute of worker safety and health in agricultural households

Abstract

The questions of basic principles of labor protection in agriculture are considered. The existing doctrinal approaches to the definition of «principles of labor protection» are analyzed. It is established that the principles of labor protection in agriculture are expressed in two ways: as a direct formulation in rule of law, and as an inference from the regulation. It is concluded that the principles of labor protection in agriculture are the main ideas, the initial provisions defining the direction and content of regulation in this sphere. Its textually are enshrined in regulatory legal acts as a different legal force, as well as various branch affiliation of constitutional and international levels and in the main regulatory legal acts of labor law, including acts of the social partnership of industry level. Special legal principles that reflect industry specificities and comply with international labor safety standards should be identified and consolidated (at the level of the new Concept on the Organization of Labor Protection in Agriculture) with the purpose to increase the effectiveness of the legal regulation of in the field of labor protection in agriculture.
