Legislative uncertainty of the concept of industrial waste as an object of administrative and legal regulation: Risks and ways of completion

Abstract

The article deals with the concept of «industrial waste» in the context of its use both at the interstate level and in the legislation of Ukraine. The place of the term «industrial waste» in the modern legal system is analyzed. The active use of the term «industrial waste» in the waste management regulations is noted, especially as opposed to the concept of «household waste» or «waste of consumption». It is noted that industrial wastes constitute the largest part of the waste generated in Ukraine, and therefore require administrative and legal regulation. The problem of absence of legislative definition of the term «industrial waste» and the negative consequences of such a situation are revealed. Taking into account the proposals for radically changing existing concepts and continuing to ignore the provision of a clear legal definition of the term «industrial waste», the risk of introducing a dangerous collision of the present situation and, as a consequence, increasing the uncontrollability of the formation and entry into the environment of industrial waste, in the event of adoption the bill of Law Ukraine «On waste management», drafted by the Ministry of Environment and the natural resources of Ukraine, which, on the contrary, should eliminate existing shortcomings and adapt Ukrainian law to the Law of European Union. The necessity of introducing the normative definition of the mentioned concept is substantiated and the author's definition is proposed.
