LEGISLATION ABOUT ORGANIC AQUACULTURE: SOME REALIZATION OF PROBLEMS

Abstract

The article deals with the scientific-theoretical analysis of the legislation, which regulates the relation of the sphere of organic aquaculture. Particular attention is paid to the reviewing of the realization problem of possibility of production of organic aquaculture products on the areas, which weren’t polluted. According to that fact the producers of the organic aquaculture products don’t have any privileges in process of the budget money separation in comparison with the other producers of the aquaculture products, question is risen about providing necessity. It is may be realized through fixation these guarantees in Law of Ukraine of September 18th, 2012 «On Aquaculture». Attention is paid thatlegislation in this sphere is contradictory. This creates additional barriers for providing such type of activity. So it isnecessary to excide the requirement to provide the environmental impact assessment for each new operator, which applies on the conversion to theorganicproduction and going to produce more than 10 ton of the aquaculture products per year, from Regulation of Cabinet of Ministers of Ukraine of October 23th, 2019 № 970. It is offer to clean up Law of Ukraine of July 10th, 2018 «On basic principles and requirements to the organic production, circulation and labeling of organic products» according to Council Regulation (EC) No 834/2007of 28 June 2007onorganicproductionandlabellingoforganicproductsandrepealingRegulation (EEC) No 2092/9, with purpose of increasing rights of the consumers organic products.
